GTC

  1. Scope
    These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all orders placed and contracts concluded via the online shop of deBabi.ch, Dorfstrasse 36, 3652 Hilterfingen, Switzerland (hereinafter “deBabi.ch,” “deBabi,” or “we”). deBabi.ch reserves the right to change these GTC, the delivery and payment terms, as well as the privacy policy at any time and bring them into effect without prior notice. We kindly ask you to read these provisions carefully each time you visit the website and when placing an order. The version of the GTC valid at the time of ordering is decisive. Any conditions deviating from these GTC require explicit written confirmation by deBabi.ch in order to be valid. By using this website or placing an order, you (hereinafter “the customer”) confirm that you fully acknowledge and accept these GTC, including delivery and payment terms.

  2. Offer
    The offer on this website is directed exclusively at customers (natural persons residing or legal entities headquartered in Switzerland). Deliveries are made only to addresses in Switzerland. The offer is valid as long as it is visible in the online shop and stock lasts. Price and assortment changes are possible at any time. The images shown in advertisements, brochures, the online shop, etc. serve for illustration purposes and are non-binding. The specific information on the product packaging is decisive.
    deBabi.ch endeavors to provide complete, correct, and up-to-date information on this website. However, deBabi.ch can neither explicitly nor implicitly guarantee this in all cases.
    deBabi.ch contains information about products and services. Price and assortment changes as well as technical modifications remain reserved.

  3. Price
    All prices are quoted in Swiss francs (CHF) and include the statutory value added tax (VAT). The price at the time of ordering in the online shop is decisive.
    Any shipping costs will be charged additionally, unless otherwise provided, and must be paid by the customer. Shipping costs are shown separately in the ordering process.
    Technical changes, errors, and typographical mistakes are reserved. In particular, deBabi.ch may change prices at any time and without prior notice.

  4. Payment Methods
    We accept the payment methods offered in the online shop.

  5. Order
    The offers on this website constitute a non-binding invitation to the customer to order products and/or services from deBabi.ch. After submitting an order, deBabi.ch automatically sends an “Order Confirmation” by email, confirming that the customer’s offer has been received. Orders placed are binding on the customer. Unless otherwise noted, there is no right of return or withdrawal. deBabi.ch is free to reject orders in whole or in part without stating reasons. In this case, you will be informed, and any payments already made will be refunded. Further claims are excluded, particularly no subsequent delivery of unavailable products will be made. Products that are temporarily out of stock cannot be reserved.

  6. Conclusion of Contract
    The contract is concluded only when the order is processed at the logistics center of deBabi.ch. As soon as the order is ready for dispatch, you will receive an order confirmation by email. Orders will be delivered only after full payment has been received (except for deliveries on account) and provided the goods are available.

  7. Delivery

    1. Delivery Area
      Your delivery address must be in Switzerland.

    2. Delivery Times
      deBabi cannot guarantee that the listed products will be available at the time of ordering. All statements regarding availability and delivery times are therefore without guarantee and may change at any time without prior notice. Any claims for damages or other claims are excluded. Orders are shipped Monday through Thursday; there is no shipping from Friday to Sunday. No deliveries are made on Sundays or on official national or cantonal public holidays. If you are not present at the time of delivery and have not provided any special delivery instructions, the delivery driver may leave the shipment in an accessible location or leave a pick-up notice in your mailbox. If you receive a pick-up notice, you must collect the delivery from the specified post office within 48 hours. You assume responsibility for the delivered products even if they were not received by you personally.

    3. Delivery Costs
      Delivery costs depend on the value of the ordered products (minimum order value excl. delivery costs, deposits, and credits). The delivery costs communicated in the online shop apply. Delivery costs are listed as an additional item in the shopping cart and on the invoice.

  8. Notice of Defects, Duty to Inspect, and Returns
    The customer is granted a right of withdrawal for 14 calendar days after receiving the goods. The deadline is met if the customer sends the written withdrawal (by email to info@debabi.ch or by letter) to deBabi.ch within this period. The withdrawal does not require justification.
    Exercising the right of withdrawal results in a reversal of the contract. The customer must return the goods within 14 calendar days in their original packaging, complete with all accessories, and together with the delivery note to the return address specified by deBabi.ch. Returns to deBabi.ch are at the customer’s expense and risk. Any payment already made will be refunded to the customer within 20 calendar days, provided deBabi.ch has already received the goods back or the customer can provide proof of shipment.
    If products are delivered with obvious damage to the packaging or contents, you should immediately complain to the service provider (e.g., carrier, postal service) without prejudice to your warranty rights and refuse acceptance of the delivery. Request a damage report from the service provider (e.g., carrier, postal service). You must also report any transport damage to deBabi.ch immediately.
    Furthermore, it is your responsibility to inspect the ordered products immediately upon receipt and to store them properly. If you find any defects or deviations from your order, you must notify deBabi.ch customer service by email at info@debabi.ch on the day of delivery. Thereafter, only hidden defects can be claimed, which must be reported immediately to customer service upon discovery.

  9. No Sale to Minors
    Under Swiss law, alcoholic beverages may not be sold to individuals under 16 years of age, and spirits may not be sold to individuals under 18 years of age. By placing an order at www.deBabi.ch, the customer acknowledges these provisions and confirms that they are authorized to purchase. deBabi.ch disclaims any liability in the event of a breach.

  10. Exclusion of Liability
    deBabi excludes any liability, regardless of legal grounds, and any claims for damages against deBabi to the extent permitted by law.

  11. Data Protection
    deBabi provides additional information in its Privacy Policy regarding how it processes personal data.

  12. Applicable Law and Place of Jurisdiction
    The place of jurisdiction for both natural and legal persons is Switzerland or the domicile/headquarters of the customer. The legal relationship between deBabi and the customer is governed by substantive Swiss law.
